  4. A Senate committee rejects another Bush appointee

  7.     The sentiment was laudable, but its source was a surprise.
  8. There, arguing for the nomination of a black attorney to the
  9. Federal Government's top civil rights position, sat South
  10. Carolina Republican Strom Thurmond, who had once declared,
  11. "There's not enough troops in the Army to break down segregation
  12. and admit the Negro into our homes, our eating places, our
  13. swimming pools and our theaters." His current rationale: "It
  14. seems to me that we ought to give this black man a chance. Years
  15. ago, minorities didn't have a chance."

  17.     Thurmond's astonishing plea for equal opportunity failed to
  18. sway a majority of the Democratic-controlled Senate Judiciary
  19. Committee. Twice the committee deadlocked, 7 to 7, on sending
  20. the nomination to the full Senate, effectively killing the
  21. appointment of William Lucas, 61, as Assistant Attorney General
  22. for Civil Rights. Republican committee members denounced the
  23. votes as bigoted and based on a double standard. Lucas was
  24. turned down, said Attorney General Dick Thornburgh in an angry
  25. statement, as a "result of raw politics."

  27.     Was that really the case? During two days of hearings on
  28. his nomination, a coalition of civil rights organizations
  29. assailed Lucas for his lack of qualifications. The former FBI
  30. agent and Republican candidate for Governor of Michigan conceded
  31. that he "was new to the law." A practicing attorney for only two
  32. years, he had never tried a case, written a brief or argued an
  33. appeal. Most damaging, Lucas displayed a woeful ignorance of
  34. basic civil rights issues. Asked about the distinction between
  35. de facto (actual) and de jure (legal) segregation, Lucas drew
  36. a blank. "If it had been a white man who had been nominated who
  37. had the same background," said Alabama Democrat Howell Heflin,
  38. "he wouldn't have gotten anywhere. I think the fact that Mr.
  39. Lucas was black caused more consideration to be given to him."

  41.     Double standards have, in fact, played a role in the
  42. Judiciary Committee's handling of the Administration's choices
  43. for important Justice Department posts. In July, Robert B.
  44. Fiske, a New York lawyer, was forced to withdraw his nomination
  45. as Deputy Attorney General. Reason: conservative Republicans led
  46. by Thurmond complained that Fiske, a highly experienced
  47. prosecutor, was too liberal.

  49.     There was another element of hypocrisy in the Republican
  50. complaints. As Lucas' proponents are well aware, there is no
  51. such thing as an apolitical political appointment. The Bush
  52. Administration, which hopes to attract more black voters to the
  53. G.O.P., certainly had that goal in mind when it selected a
  54. black for the civil rights post. It has not ruled out giving
  55. Lucas a "recess appointment" to the job while Congress is out
  56. of session, which would allow him to serve until the end of 1990
  57. without being confirmed. But if the Administration goes that
  58. route, it is sure to anger the Senate, endangering the
  59. President's future appointments and proposals. When the Senate
  60. returns after Labor Day, the President and his Attorney General
  61. face another firefight over the nomination of Clarence Thomas,
  62. the ultraconservative black chairman of the Equal Employment
  63. Opportunity Commission, to the federal appeals court in
  64. Washington. That battle might give Thurmond another opportunity
  65. to cast himself as a sanctimonious champion of civil rights.
